Terms and Conditions
The responsibilities that accompany use of SurfLocal.us and its connected business tools.
1. Operator and scope
These terms describe use of SurfLocal.us, operated by Surflocal Media LLC. They cover the public site and the platform features made available to your account. Access to a feature depends on its availability, permissions, configuration, and any separate agreement. These terms do not promise access to every tool, demonstration, or internal back-office program.
Where acceptance is required, review these terms before accepting them or using the relevant service. A separate written agreement governs a conflict concerning its specific subject. These terms do not create a new price, payment schedule, refund policy, or cancellation arrangement.
2. Accounts and authority
You must have legal capacity and authority to act for the business or account you manage. Supply accurate information, keep account access secure, and promptly report suspected unauthorized use. Do not use another business's identity or access its records without authorization. Permissions given to staff or other users must reflect their legitimate responsibilities.
3. Business content and publishing
You remain responsible for information, offers, media, messages, and other content you submit or approve. You must have the rights and permissions needed to use that material, including trademarks, photographs, customer information, and third-party work.
You retain any rights you hold in your content. You give SurfLocal permission to host, process, reproduce, format, and publish it as reasonably necessary to provide the features you request. Publishing makes content available to visitors and potentially search engines, caches, and others outside SurfLocal's control. Review content and publication destinations before approving a release.
SurfLocal and its licensors retain their rights in the platform, software, templates, branding, and other platform materials. Access does not transfer ownership of those materials or grant rights beyond the authorized use of the service.
4. Opportunities, marketing, and assisted output
Opportunity suggestions, marketing drafts, search information, and AI-assisted output are aids to business judgment, not guarantees of traffic, rankings, revenue, legal compliance, accuracy, or exclusivity. Review factual statements, prices, qualifications, intellectual-property rights, and regulated claims before use.
Search engines, directories, review services, and other providers control their own decisions. SurfLocal does not guarantee indexing, placement, review removal, or a particular business outcome.
5. Customer response and communications
You are responsible for responding to your customers, confirming appointments, fulfilling your offers, and obtaining permissions for communications. A submitted appointment request is not necessarily a confirmed appointment. Messaging and calling features are subject to the Messaging Terms and applicable provider requirements.
Do not rely on website chat, email, text, or browser calling for emergency assistance. Use your local emergency service through an appropriate telephone service.
6. Connected services and availability
External services may require separate accounts, permissions, or terms. Availability and performance may depend on those services, internet access, devices, maintenance, and account settings. Features may change or be restricted for security, abuse prevention, provider requirements, or operational reasons, subject to applicable law and any governing agreement.
Keep appropriate copies of important business content and records. A preview, archive, or history feature is not a promise of indefinite storage or a substitute for your recordkeeping responsibilities.
7. Permitted use and enforcement
Follow the Acceptable Use Policy. We may investigate reported misuse and restrict affected access or content where reasonably necessary to address security risks, unlawful activity, violations, or provider requirements. When appropriate and feasible, we may request corrective action. Enforcement must remain subject to applicable law and any controlling agreement.
8. Disclaimers and legal rights
To the extent permitted by applicable law, the website and platform tools are provided as available, without promises that they will be uninterrupted, error-free, or fit every business purpose. SurfLocal does not provide legal, medical, financial, or other licensed professional advice through general platform output.
Nothing here excludes obligations or liability that cannot lawfully be excluded, waives mandatory consumer rights, or excuses fraud or other conduct for which responsibility cannot be disclaimed. These terms do not impose mandatory arbitration, a class-action waiver, or a fixed monetary liability cap.
9. Changes and questions
Material changes to these terms will require appropriate notice and any acceptance required by law or an applicable agreement. A change does not retroactively alter an existing agreement where that is not permitted. Contact contact@surflocal.us about these terms or a service concern.
